In the United States, it is legal to apply death penalty to someone who is not AmericanUS states that the death penalty will execute citizens and non-citizens alike. This is a reason that many nations will not extradite (forcibly return) people to the US if they are potentially facing execution. He/She will not "just be deported" because a deported person is not subject to any punishment other than being sent back home. 
This law has created a lot of controversy, since it does not the immigrant's original country to influence on the matter. While other countries oppose, the United States stands by its decision to give the death penalty to foreign people.
